It may not be illegal, but it's completely lame when a Myspace entry has nothing to do with the person it's for. It's called "Myspace", not Hisspace or Herspace.

BTW, don't fool around with Myspace. It's a cult.:cool:

Do you suppose they have paid ASCAP fees for each stream of the 4 songs? If so, I hope Be and JC get a share of the $$. I suspect they are infringing copyrights for those songs.

They probably have no idea what ASCAP is. That part of it IS illegal.

And here is how worried they are about copyright law. They probably hope to make everything go away with this FAQ:

As an aside, MySpace is run on ColdFusion (I'm on the ColdFusion Engine team) and according to different statistic sites is either the fifth or most visited site on the web each day. If you're older than like 25 or so, though, you have no idea what myspace is. (I didn't till we made them go into license compliance with CF server licenses...)

whats with all the "friends" ?????? some of them appear to be fake entries.. did some pm dawn fan make that account for promotion?? very weird..

if the songs are getting played that often and its in that little player only then maybe its doing more promotion than harm.. myspace is a little weird

i dont think theres anyway for an artist to get paid through myspace other than just promotion. all the accounts and hosting services are free. you are suppose to own the copyright to any material you post when you make a music account. i doubt the guy who made this had any malice intended, some people make an account for a band they like because the band themselves hadnt done so and wish to promote them.

Hey, Brian, ask Be what he thinks about replacing those songs with the ones that freely stream from pmdawn.net (I assume there is no problem with those). In that case, Be could write in to the admins on the site saying it is his (band's) name and they will most likely give him control. Then he could give you guys who run things the keys to that and we can make it a nice place. That could do lots of promotion with the younger crowd... - if that is what we / PM dawn is looking for. Links to Amazon for buying the CDs, etc.

I was talking about MySpace in the first place. They are the ones providing the computers and technology to stream the music to the visiters. I would think MySpace would be responsible if they allow folks to store and stream copywritten music from their site/servers.

And from the looks of that paragraph, they seem a little familiar with the legal issues they may be bumping up against. Looks like they are trying to bury folks in paper work to get things removed.

Good point, If they've partnered with ASCAP there's a good possibility that they have a blanket fee arrangement with the performance rights societies. If this is the case then the people who are doing the streams just may be doing Be a favor, depending on how the performances are sampled or reported.
